Trademark Trouble Since the creation of an LLC requires the members to, pre à §7-80-203 of the Colorado Revised Statutes, which states, ââ¬Å" One or more persons may form a limited liability company by delivering articles of organization to the secretary of state for filingâ⬠(Col. Rev. Stat. 2013, à §7-80-203). Due to this requirement, I researched Mrs. Jacksonââ¬â¢s possible trademark name of ââ¬ËThe Gathering Placeâ⬠. With in the Colorado Secretary of State Office business name, trademark, and trade name records database, I found a number of records for businesses named ââ¬ËThe Gathering Placeââ¬â¢. Both ââ¬ËThe Gathering Place: A Refuge for Rebuilding Livesââ¬â¢ (Col. Sec. Stat. 20131400199, 2013) and the ââ¬ËThe Gathering Place Churchââ¬â¢ (Col. Sec. Stat. 20131131269, 2013) hold effective - currently valid - trademarks and trade names to the phrase ââ¬ËThe Gathering Placeââ¬â¢ with an extension to the phrase such as ââ¬Ëchurchà ¢â¬â¢ or ââ¬Ëa refuge for rebuilding livesââ¬â¢. Although, the formerly listed companiesââ¬â¢ phrases maybe distinct enough from Mrs. Jackson to use the phrase ââ¬ËThe Gathering Placeââ¬â¢, the Good Standing status of a company with the name ââ¬ËThe Gathering Place Inc.ââ¬â¢ (Col. Sec. Stat. 20141495695, 2014) would not allow Mrs. Jackson to use the phrase as the name of her business. Based on this finding she will not be able to use ââ¬ËThe Gathering Placeââ¬â¢ for her business.
